The Terms and Conditions, Privacy Policy and License Information are not intended to alter the terms or conditions of any CLASSIC IMAGES STOCK FOOTAGE NON-EXCLUSIVE LICENSE AGREEMENT and to the extent of any conflict, the terms of your CLASSIC IMAGES STOCK FOOTAGE NON-EXCLUSIVE LICENSE AGREEMENT will prevail. By using the Site, you represent and warrant that you are of legal age, not under the age of 18, and are lawfully able to accept the Site Terms and Conditions, Privacy Policy and License Information and are not barred from receiving services under the laws of the United States or any other jurisdiction. If you are using the Site on behalf of any third party or entity, you further represent and warrant that you are authorized to accept the Site Terms and Conditions, Privacy Policy and License Information on such third party’s or entity’s behalf, and that such third party or entity agrees to indemnify Classic Images Stock Footage for violations of the Site Terms and Conditions, Privacy Policy and License Information.

Registering for a Classic Images Stock Footage Account

In registering for a Classic Images Stock Footage account and to access certain services, you are required to provide current, accurate identification, contact, and other information as part of the registration process and/or continued use of Classic Images Stock Footage Site. You are responsible for maintaining the confidentiality of your account password, and are responsible for all activities that occur under or by your account. You represent and warrant that you will comply with all applicable laws and regulations, including, without limitation, those relating to the Internet, data, e-mail, privacy, and the transmission of technical data exported from the United States or the country in which you reside.

Copyright Infringement and Complaints Policy

In accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable laws, Classic Images Stock Footage has adopted a policy of terminating, in appropriate circumstances and at Classic Images Stock Footage sole discretion, account holders who infringe the intellectual property rights of Classic Images Stock Footage or any third party.

The Classic Images Stock Footage trademark, the Classic Images Stock Footage logo, and any other product or service name or slogan contained in the Classic Images Stock Footage Site are trademarks of Classic Images Stock Footage and its suppliers, and may not be copied, imitated or used, in whole or in part, without the prior written permission of Classic Images Stock Footage or the applicable trademark holder. You may not use metatags or any other "hidden text" utilizing "Classic Images Stock Footage" or any other name, trademark or product or service name of Classic Images Stock Footage without our prior written permission. Indemnification

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF CLASSIC IMAGES STOCK FOOTAGE, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER THEORY, ARISING OUT OF OR RELATING TO THE USE OF THE SITE EXCEED ANY COMPENSATION YOU PAY, IF ANY, TO CLASSIC IMAGES STOCK FOOTAGE FOR ACCESS TO OR USE OF THE CLASSIC IMAGES STOCK FOOTAGE SITE.

Law, Jurisdiction and Venue

Any dispute relating in any way to your use of the Site or the Material shall be submitted to arbitration in Los Angeles, California, except that, to the extent you have in any manner violated or threatened to violate Classic Images Stock Footage intellectual property rights, Classic Images Stock Footage may seek injunctive or other appropriate relief in any state or federal court in the State of California, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this provision shall be conducted by a single arbitrator under the rules then prevailing of the American Arbitration Provision. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to the Site Terms and Conditions, whether through class arbitration proceedings or otherwise.

Termination

Notwithstanding any of these Site Terms and Conditions, Classic Images Stock Footage reserves the right, without notice and in its sole discretion, to terminate your account and/or to block your use of the Site.

Submissions
